Nomination Procedure and Threshold

Composition of the Nominating Committee:

The Nominating Committee shall comprise popularly elected Legislative Councilors.

Nomination Threshold:

The nomination procedure is dual-tracked:
(1) Civil Nomination:
This track is indispensable. The nomination threshold is set at requiring signed
endorsement from 1% from of the total number of registered voters (presently at
35,000 voters). The nominating period shall not be less than 2 months, and the
Nominating Committee shall not have any veto power in relation to the official
candidate put forth via this track.
(2) Nomination by the Nominating Committee:
The nomination threshold is set at requiring signed endorsement from 8% of the
total number of members in the Nominating Committee. Each candidate can have
support from no more than 20% of the total number of members. Each member of
the Nominating Committee can only nominate one candidate.

The election shall employ the two-round, run-off system by universal suffrage. A
candidate is elected as Chief Executive by winning a requisite simple majority (more
than 50%) of the valid votes in the first round. If no candidate wins the requisite
simple majority in the first round, a run-off election (second round) shall be held
between the two highest-placed candidates, in which the candidate with more votes
shall be elected as Chief Executive.

Remarks:

The Chief Executive Election Ordinance (Cap 569) should be amended to the extent
that there should be no restrictions as to the number of candidates running for office as Chief Executive, or as to the political background or party affiliation of the candidate.
If Civil Nomination is regarded as a contravention of Article 45 of the Basic Law, the SAR Government should propose bills for amendments of the Basic Law in accordance with Article 159 to include civil nomination and other election methods 28 by universal and equal suffrage into the Basic Law, so as to discharge its obligation of reflecting Hong Kong citizens’ firm insistence on civil nomination.
One-off legislation (amendment) should be enacted to abolish functional
constituencies in Legislative Council elections to reflect the goal of universal suffrage.

The Nominating Committee must endorse one’s candidacy if the potential candidate satisfies the requirement in Article 44 of the Basic Law, and, within a nomination period of at least 4 weeks, satisfies any of the three requirements below:

A person is to be nominated as a candidate through any one of the following procedures:
(1) Civil Nomination: A nominee having received the signed endorsement of 1% of the registered voters shall be endorsed by the Nominating Committee.
(2) Political Party Nomination: Any political party or political group having
received 5% or more of the total valid votes in the last Legislative Council
direct election can independently or jointly nominate one person as nominee. The nominee shall be endorsed by the Nominating Committee.
(3) Nomination by the Nominating Committee: Members of the Nominating
Committee shall conduct direct nominations.

Nomination procedure:

Candidates “nominated” via civil nomination and party nomination must ultimately obtain the endorsement of the Nominating Committee, but the nominating committee shall not refuse to endorse any legal nominations by civil nomination and political party nomination. Conditions such as “love China, love Hong Kong” and “no confrontations with Beijing” amount to political censorship and are not permissible in seeking to deny potential candidacies.

Composition of the Nominating Committee:

The Nominating Committee shall be comprise 160 members via the same principles underlying the notion of “Four Sectors” in the present composition of the election
committee. The first three sectors of the present election committee shall be reflected in the Nominating Committee by 35 members: the 30 Legislative Councillors returned
by the existing the Functional Constituencies (excluding the 5 Legislative Councillors returned from the District Council (second) Functional Constituencies), with the addition of a religious leader, a student representative and three members of the civil service.
The Fourth Sector will be reflected in the Nominating Committee by 125 members:
all 36 National People's Congress local deputies; all 31 members of the National Committee of Chinese People's Political Consultative Conference; 18 elected District
Councillors (from 18 districts); and the remaining 40 Legislative Councillors returned from Geographical Constituency direct elections and the District Council (second) Functional Constituency elections.

Nomination Threshold:

Each member of the Nomination Committee shall be entitled to recommend one candidate for consideration (12.5%); and no candidate shall receive more than 64 recommendations (40%).

Composition of the Nominating Committee:

In accordance with the NPCSC Decision in 2007, and with reference to the present Election Committee, the Four Sectors shall be retained, expanded and reflected in the Nominating Committee by a body of 1,500 members.
The Fourth Sector shall expand to include 400 popularly elected District Councilors.
The electorate bases of the First and Third Sectors shall be expanded: corporate votes in the First Sector shall be replaced by votes via individual directors of body
corporates; union votes in the Third Sector shall be replaced by votes via individual union members.

Nomination Threshold:

The nomination procedure involves two statutory stages:
(1) First stage – civil nomination:
A person qualifies as a “potential candidate” upon the satisfaction of Article 44 of the Basic Law and upon the collection of jointly signed endorsements of 100,000 registered voters (approximately 3% of the total number of registered voters).
This is a necessary and singular route through which all aspiring potential
candidates must go. This ought to be included in the Appendix to Basic Law
and the Chief Executive Election Ordinance.
(2) Second stage – nomination via the Nominating Committee
In accordance with Article 45 of the Basic Law and the principle of
organizational nomination, the Nominating Committee shall pass a resolution to nominate a potential candidate as an official Chief Executive candidate upon his/her collection of 10% of the votes (150 members) in the Nominating Committee. Each member of the Nominating Committee shall have 1 vote. In theory, the Nominating Committee may nominate no more than 10 persons as official Chief Executive candidates.

With reference to the 2016 Legislative Council General Election, the percentage of the total number of valid votes all candidates from a political party obtain from Geographical Constituency direct elections shall determine the proportion of seats the
political party gets in the Nominating Committee. For instance, in the 2012
Legislative Council General Election, each percent (1%) of the total number of valid votes (18,400 votes out of a total of 1,840,000 votes) shall ensure one percent (1%) of the seats in the Nominating Committee (12 seats out of a total of 1,200).

Nomination Threshold:

Any political party representative nominated by no less than one-eighth, and no more than one-sixth, of members of the Nominating Committee (i.e. no less than 150, and no more than 200, members) shall qualify as a candidate running for office.

A person qualifies as a candidate if he is nominated by at least 10 members of the Nominating Committee (i.e. 10 Legislative Councilors). Each Legislative Councilor can only nominate one person.

Composition of the Nominating Committee:

Nominating Committee shall be formed with reference to the Election Committee’s current composition consisting of the Four Sectors, with its representation broadened as recommended below:
The first sector
1. The Financial Services subsector’s electorate base should be broadened to include all financial services practitioners in the previous year;
2. The Insurance subsector’s electorate base should be broadened to include all insurance practitioners in the previous year;
3. The Tourism subsector’s electorate base should be broadened to include all tourism members in the previous year;
4. All corporate or institutional voters of these sectors should be eliminated.
The second sector
5. The Architectural, Surveying and Planning subsector’s electorate base
consisting of members entitled to vote at general meetings should be
broadened to include all members.
6. The Chinese Medicine subsector’s electorate base consisting of members
entitled to vote at general meetings should be broadened to include all
members.
7. The Engineering subsector’s electorate base consisting of members entitled to vote at general meetings should be broadened to include all members.
8. The Information Technology subsector’s electorate base consisting of members entitled to vote at general meetings should be broadened to include
all members. All corporate voters should be eliminated.

The third sector
9. The Social Welfare subsector’s electorate base should be broadened to include all practitioners in the previous year. All corporate voters should be eliminated.
10. The Sports, Performing Arts, Culture and Publication subsector’s electorate base should be broadened to include all members in the previous year. All of the current subsector voters will thus be unnecessary and should be eliminated.
The fourth sector
11. All elected members of the District Council should be ex-officio members of the Nominating Committee. All of the current District Council members’
representatives will thus be unnecessary and should be eliminated.
It is expected that the electorate bases for the first three sectors would expand from the current 200,000 people to 1 million people. The above change shall transform the 1,200 member Election Committee into a 1,514 member Nominating Committee.

Nomination Threshold:

The nominating threshold is to remain at 150 members, while a nominating ceiling is to be imposed at 200 members, so that the number of Chief Executive candidates will
be limited to 7 to 10.

Voting System::

The election shall employ the instant-runoff voting system by universal suffrage.
Voters may either vote for a single candidate, or instead rank the candidates in order of preference on their ballots.
Ballots are initially distributed based on each elector's first preference. If a candidate secures more than half of votes cast, that candidate wins. Otherwise, the candidate
with the fewest votes is eliminated. Ballots assigned to the eliminated candidate are recounted and assigned to those of the remaining candidates who rank next in order of preference on each ballot. This process continues until one candidate wins by obtaining more than half the votes.

Composition of the Nominating Committee:

All corporate votes in the First, Second and Third Sectors be abolished and replaced by voting by individuals, who may each vote in only one sub-sector;
The composition of the Fourth Sector be amended to include representatives of all other registered voters who are not entitled to elect representatives in the First, Second or Third Sectors.
Specifically, the (currently 117) District Councilor seats in the Fourth Sector of the EC, which are elected from amongst elected District Councilors rather than the general electorate, be replaced by seats directly elected by all registered voters who are not entitled to vote in any other sector.
Open elections will be held in each of the eighteen District Council districts for the specific purpose of selecting Fourth Sector NC members and that the number of NC seats elected by each district be determined in proportion to the size of that district’s population.
In accordance with this formula the size of the NC would be increased to 1,400 seats with the First, Second and Third Sectors retaining 300 seats each and the Fourth Sector expanded to 500 seats as follows:

Nomination Threshold:

Any person who meets the criteria in Article 44 of the Basic Law, and who obtains nominations from at least one-tenth of the total number of NC members in the Four Sectors, that is 140 nominations, will be nominated by the NC.
Each member of the NC should be able to cast only one vote.
There should be a cap on the number of votes that any individual candidate can secure, to ensure that competing candidates are not squeezed out of the running from the outset; we suggest an appropriate limit would be 25% of the total number of NC
members.
There should be no limit on the number of CE candidates; the number of candidates should be a product of the nomination system, not an artificially imposed constraint on the choice available to voters.

Nomination Procedure and Threshold

Composition of the Nominating Committee:

It should be composed of 1,200 members elected from "broadly representative" sectors of society, with reference to and through expansion of the sectors in the current Election Committee. To assist the legislative process, an independent working
group headed by a member of the judiciary should be appointed to make
recommendations for inclusion in sectors based on the following criteria:
• That the overall constituent base for electing the nominating committee be
increased substantially, opening space for all voters to register under an
appropriate sector;
• That there be no corporate voters and no discrimination against any class of
voters in order, for example, to include among constituents in the various
sectors such grass-roots groups as support staff, shareholders, sole proprietors, frontline workers, homemakers and civil servants;
• That each constituent sector and the number of voters for each seat within a
sector be roughly equal; and,
• That the fourth political sector be made up primarily of directly elected
legislators and district councilors, without precluding their constituents voting in other sectors.

Nomination Threshold:

Any candidate who meets the Basic Law criteria in Article 44 concerning age, citizenship and residency and is nominated by 12.5 per cent of the nominating committee members shall be presented to the voters for election based on universal suffrage. Each person in the committee shall nominate only one candidate. There
should be no formal limit on the number of candidates nominated except as a result of these constraints. The statute should provide for prompt judicial oversight. To better consult the public, a candidate who obtains a minimum of 10,000 signatures
from registered voters should be given consideration for nomination in good faith by committee members to reach the required 12.5 per cent threshold.

The election among the nominated candidates shall be based on universal and equal suffrage. If no candidate receives more than 50 per cent of the vote, there would be a second round run-off two weeks later involving the two candidates who received the

Composition of the Nominating Committee:

In designing the Nominating Committee, initial reference should be made to the existing Election Committee. However, the Nominating Committee will need to be more representative than the existing Election Committee. There are many ways in which representativeness can be enhanced, but the issues are complex and technical.
The task of studying and recommending reforms in this regard should be given to an independent Election Reform Committee (ERC) who will have six months to study and report on its proposals. The ERC should have no more than ten members
including those who have knowledge or experience of Hong Kong’s electoral laws.
Ideally, the ERC should be chaired by a current or former member of the Judiciary, and secretariat support should be provided by the government. Some issues to be
considered by the ERC include the size of the Nominating Committee, the abolition and replacement of corporate voting, the delineation of sectors and subsectors, the incorporation of more District Council members and/or directly elected members, and
the expansion of membership to sectors and groups historically without effective representation.

Nomination Threshold:

To be a qualified person to seek standing to be nominated as a Chief Executive candidate (“qualified person”), an individual must be a Chinese citizen of not less than 40 years of age who is a permanent resident of Hong Kong with no right of
abode in any foreign country and have ordinarily resided in Hong Kong for a
continuous period of not less than 20 years. Candidates may be a member of a political party.
Only a qualified person who have been endorsed by one of the following two methods shall have standing to be nominated by the Nominating Committee as a Chief Executive candidate.
a. Endorsement from the Nominating Committee membership. A qualified person who obtains the endorsement of at least one-eighth (12.5%) of the members of the Nominating Committee shall have standing to be nominated by the Nominating Committee. Such persons are referred to as having “Track A” standing. A
Nominating Committee member may endorse no more than one qualified person, whether for Track A or Track B standing, in any round of nomination.
b. Endorsement from General Electors. A qualified person who obtains the
endorsement of at least 5,000 general electors shall have standing to be nominated by the Nominating Committee. Such persons are referred to as having “Track B” standing. A person may not have Track A and Track B standing at the same time.
A “general elector”, having the meaning of “elector” in “geographical
constituencies” in the Legislative Council Ordinance (Cap. 542), may endorse no more than one qualified person, whether for Track A or Track B standing, in any round of nomination.
Persons with standing to be nominated by the Nominating Committee may be
nominated as a Chief Executive candidate by one of the following two methods.
a. Nomination by voting. In a vote of the Nominating Committee in which only persons with Track A standing compete, the three persons (or less than three where
applicable) with the greatest number of votes and individually obtaining votes from at least one-eighth (12.5%) of all voting Nominating Committee members shall be returned as Chief Executive candidates.
b. Nomination by threshold voting. In a vote of the Nominating Committee in which only persons with Track B standing compete, persons who obtain votes from at least one-eighth (12.5%) of all voting Nominating Committee members shall be returned as Chief Executive candidates. There shall be no limit to the number of persons who can be nominated by this method.

Nomination procedure:

Voting System::

A general elector shall have the right to vote for a Chief Executive candidate on a one person, one vote basis. Depending on the number of candidates for Chief Executive,
the following election methods should be used.
a. One candidate. Where there is only one candidate for Chief Executive, the
candidate must obtain at least 50% support of all those voting in an election of general electors in order to be returned as the Chief Executive-Elect. If the candidate obtains less than 40% support, the above nomination process shall be repeated. If, however, the candidate obtains 40% or more but less than 50% support, a second round of voting shall be held within 30 days.
b. Two candidates. Where there are only two candidates for Chief Executive, the candidate who obtains the greatest number of votes in an election of general electors shall be returned as the Chief Executive-Elect.
c. Three or more candidates. Where there are three or more candidates for Chief Executive, the candidate who obtains the greatest number of votes and has obtained at least 50% of the votes of all those voting in an election of general electors (“50% threshold”) shall be returned as the elected Chief Executive. If no candidate has obtained the 50% threshold, a second vote shall take place within 30 days of the first vote in which only the two candidates with the most votes in the first vote shall compete. After the second vote is held, the candidate who obtains the greatest number of votes in an election of general electors shall be returned as the Chief Executive-Elect.

Appointment:

The Chief Executive-Elect shall be appointed Chief Executive by the Central People’s Government in accordance with Article 45 of the Basic Law. If the Central People’s Government decides not to appoint the Chief Executive-Elect, it will be necessary to repeat the above nomination and election steps of the process.

The Nominating Committee shall be constituted with reference to the present constitution of the Election Committee. The number of Nominating Committee members will be increased to 1,800 people on the following basis:
1. 1,200 members will be returned via the present routes in the Election
Committee with reference to the Four Sectors;
2. 600 members will be returned via elections across the 18 Districts of Hong
Kong. These 600 said members may constitute a Fifth Sector, or be evenly
distributed across the Four Sectors, thereby increasing the members of each sector by 150 members.

Nomination Threshold:

To qualify as an official candidate running for office, a person must obtain the signed endorsement of at least one-tenth (180) of the total number of Nominating Committee
members.

Nomination procedure:

Voting System::

The election shall employ the two-round voting system in the following manner:
During the first round, voters each have two positive/negative votes – they may either cast two positive votes in support of two candidates respectively, or cast one positive vote in support of one candidate and one negative vote in disapproval of another candidate, or cast two negative votes in disapproval of two candidates. Each voter may not cast two votes (positive or negative) for one single candidate. The two candidates obtaining the highest number of net votes (one negative vote cancels out
one positive vote) shall enter the second round of voting.
During the second round, voters each have one positive vote. The candidate with more votes shall be elected as Chief Executive.

Candidates must abide by the relevant Basic Law and constitutional provisions, upon the failure of which, the candidate may be deprived of their candidacy or electoral status and would subject themselves to the relevant law enforcement agencies in
Hong Kong.
